ENDORSEMENT
1This matter was referred to me on June 11, 2026 by the Registrar’s office pursuant to Rule 2.1.01(7) of the Rules of Civil Procedure following receipt of a request from counsel for the defendant, York Condominium Corporation No.340 dated March 18, 2026. The request is to dismiss the action as against it on the basis it is frivolous, vexatious and/or an abuse of process. That is, the claim, is drafted, fails to disclose a cause of action, does not properly identify the parties or, where it is obvious that it cannot succeed.
2In accordance with Rule 2.1.01(1), the Statement of Claim, or pleading, is evaluated “on its face” or without any other material.
3I was only provided a one-page description of some undated events involving the plaintiff apparently renting a premises, some interactions and observations by him and being evicted after twelve days. The full name of the involved parties was not included. The request for dismissal, which contained a title of proceeding as required under Rule 14.06 was not included as part of the Statement of Claim. I enquired with the Registrar’s office if this single page was the entire pleading and was advised that was correct.
4There are no specific claims of any wrongdoing by the defendant York Condominium Corporation No. 340. There are no particulars of any breaches or any duties owed by this defendant to the plaintiff as having occurred. In the absence of any coherent allegations of how this claim could succeed, it is an abuse of process.
5As a result, I order the claim be dismissed as against York Condominium Corporation No. 340.
6No request was made for costs and there is no order as to costs.
