REASONS FOR JUDGMENT
1This is an appeal from a Consent Capacity Board (the “CCB”) decision upholding a finding that the Appellant was incapable of consenting or refusing to consent to treatment with antipsychotics and mood stabilizing medications.
2The Appellant did not appear at the hearing of this appeal. Justice DesRosiers appointed an amicus curiae (“amicus”) who attended and provided submissions to the court.
3The Respondent argued that the appeal should be dismissed as abandoned because the Appellant has chosen not to appear. In the alternative, the Respondent submits that the appeal should be dismissed on the merits.
4For the reasons that follow, I am dismissing this appeal on the merits, and not on the Appellant’s failure to appear.
