A. Overview
1Mr. Acosta has been found guilty of three counts of trafficking methamphetamine (crystal meth) and three counts of possessing property obtained by crime. At trial, Mr. Acosta conceded the Crown had proven beyond a reasonable doubt that he sold a small amount of crystal meth to an undercover officer on three occasions. Mr. Acosta also conceded the Crown had proven beyond a reasonable doubt that he was in possession of proceeds of crime. Mr. Acosta brought an application for a stay of proceedings on the basis he had been entrapped, which I dismissed: R. v. Acosta, 2025 ONCA 6139.
2It is now my job to determine the appropriate sentence for Mr. Acosta. The Crown argues the appropriate sentence is 15 months in custody on each count of trafficking and 6 months in custody on each count of possessing property obtained
