SUPPLEMENTAL COSTS ENDORSEMENT

1In a previous Endorsement (2025 ONSC 6916) I ruled on the plaintiff’s summary judgment motion and in a subsequent Costs Endorsement (2026 ONSC 694) I awarded the defendants their costs on the summary judgment motion, on a partial indemnity basis. I asked the defendants to provide a further Costs Outline clarifying their partial indemnity costs on the motion. They have now provided it.

2Based on their updated Costs Outline and the reasons set forth in the Costs Endorsement, I order the plaintiff to pay the defendants their costs of $17,542.69, which reflects the defendants’ fees on a partial indemnity basis, plus HST and disbursements. In my view, this result is fair and reasonable in all the circumstances.

3This amount is to be paid within 30 days.
