ENDORSEMENT RELATING TO MINI TRIAL TO BE HELD
[1] I held a case conference today to discuss with the parties the process for the mini trial scheduled for January 30, 2024.
[2] The defendant has retained new counsel who attended.
[3] I advised the parties my view that the mini trial could be conducted with only the two parties as witnesses, but that if the parties thought it advisable they could call some additional witnesses. I emphasized the concept of proportionality and the fact that the parties had already put in witness evidence related to the issue which will be heard at the mini trial.
[4] The parties then raised the fact that they may wish to refer to some additional documents or materials outside the record. I again discussed with them the concept of proportionality and the fact that they had already put in materials on the issues. Nevertheless, both parties agreed that some limited additional materials could be referred to by the parties.
[5] I am directing that the parties exchange a list of witnesses and their proposed evidence to the extent that it is not already contained in the affidavit material filed by January 20, 2024. I am also directing that they exchange any additional materials by January 20, 2024.
[6] If any issues arise regarding the scope of such materials, the parties may arrange another case conference with me.
