The Applicant brings this Motion apparently seeking leave to appeal the Order of Mitrow J., dated November 29, 2023. It appears that the Motion was commenced by 14B Motion pursuant to the endorsement of Mitrow J., which provides that there shall be no further Motions in the case unless permission is obtained in advance by serving and filing a 14B Motion describing the relief to be sought and the grounds for same.
In my view, the Order of Mitrow J. would not be intended to apply to Motions for leave to appeal the Order or for a stay of the Order.
A Motion for a Stay of an interlocutory Order pursuant to Rule 63.02 would need to be served and filed in the regular course and a Special Appointment scheduled on the return of the Motion.
In the event that permission is required for the Applicant’s Motion, then permission is granted and the Motion should be served and filed as per the Rules of Civil Procedure.
