Endorsement
The matter returns to update the court on the parties readiness for trial.
Applicant is now acting in person. She was encouraged by me to attempt to retain counsel as this is a most important and complex matter.
Applicant has not retained an expert in Kuwaiti family law.
She requests that the respondent provide her with all of the court documents that exist in the Kuwaiti court system relating to parenting proceedings. She advises that she is unable to obtain these documents herself. Respondent’s counsel advises that it is the respondent’s understanding that she can. He is able to access to his documents.
Applicant is to send respondent’s counsel an email listing all of the documents that she is requesting. An attempt to provide these documents will be made by respondent and his counsel.
Respondent’s counsel advises that applicant has not complied with certain aspects of an order made by Justice Korpan earlier this year. A copy of this order is not in the court’s electronic file. Respondent can take such steps as advised to address this. I suggested that counsel and applicant communicated directly regarding this as a first step.
Applicant and children’s counsel do not wish to proceed with relationship counseling with the person proposed by the respondent.
Children’s Lawyer has filed an expert report.
It appears that preliminary steps with a view to possibly resolving this matter will not be pursued. This case must now be tried as quickly as possible.
The trial coordinator kindly attended at this hearing. She will work with a local administrative judge to schedule an expedited trial.
Order:
[1] This case is adjourned to September 5, 2023 at 9:00 AM virtually before me for an update on trial readiness.
[2] Two Arab English interpreters are required for the next scheduled virtual appearance before this court.
