This is an international child abduction case: see r. 37.2
The matter was before the court today for the commencement of trial.
Counsel asked that the matter be adjourned to deal with issues related to document disclosure and counseling for the children.
The applicant is working on obtaining an expert report on family law in Kuwait. As well, the applicant requires all the documents related to the Kuwaiti decisions and judgments that have been made in that country regarding these parties.
The Children’s Lawyer intends to file an expert’s report.
The parties agree that relationship counseling for the children is called for in this case, at this time.
The parties filed a consent endorsement request dated July 31, 2023 signed by all counsel.
This matter will next be before the court on August 11, 2023 at 8:30 AM virtually before me to address the following:
has the Children’s Lawyer’s expert report been served;
has of the applicant been able to obtain a family law expert in Kuwait; and
has a counselor for the children been retained and if so the timeline for receiving a report.
Counsel expect to be able to file a “two-page write-up” detailing the steps taken by each party to move the matter forward and then outstanding barriers to have this matter tried expeditiously. It is also expected that counsel will be able to set a date for the commencement of the trial.
Order:
[1] An order shall issue in terms of the consent endorsement request.
[2] Two Arab English interpreters are required for the next scheduled virtual appearance before this court on August 11, 2023 at 8:30 AM
