A. Introduction
[1] Pursuant to the Class Proceedings Act, 1992,[^1] Justice Paul Perell of the Ontario Superior Court of Justice is case managing the Ontario class actions, Brazeau v. Canada (Attorney General) and Reddock v. Canada (Attorney General).
[2] Pursuant to the Québec Code of Civil Procedure,[^2] Justice Chantal Masse, of the Superior Court of Québec is case managing the Québec class action, Gallone c. Canada (Attorney General).[^3]
[3] This is Part 8 of our jointly written decision or judgment in Brazeau, Reddock, and Gallone. While it is a jointly written decision, it may and should be read as separate decisions of the Ontario Superior Court of Justice and of the Superior Court of Québec.
[4] The motion now before the court is a made on consent for a direction or a variation to the Distribution and Issues Protocol. The parties seek an Order in the form of the Order attached as Schedule A.
[5] We approve the issuance of the requested Order.

ORDER (LATE CLAIMS)
ON READING the motion record of the Plaintiffs and the consent of the parties,
THESE COURTS ORDER THAT The class members listed in Appendix 1 filed a claim after November 7, 2022 - the end of the claims period - and before March 7, 2023 - the end of the extended period to make a late claim. These class members are granted leave to file late claims since they met the reasons requirement of paragraph 7.2 of the Individual Issues Protocol (IIP).
The class members listed in Appendix 1, section 1 have at least one placement in administrative segregation of more than 15 consecutive days on or after March 3, 2011. These class members will be entitled to receive $5,469.85 (inclusive of all prejudgment interest and no further interest). Epiq, the claims Administrator, and Correctional Service of Canada will be responsible for transferring $5,469.85 to these class members pursuant to the process and deadlines set forth at paragraph 3.13 of the IIP. That amount is the equivalent to what class members who made their claim on time before November 7, 2022, and who had at least one placement of more than 15 consecutive days on or after March 3, 2011, received pursuant to paragraph 1.3(j) of the IIP. The class members listed in Appendix 1, section 1, will also have $8,411.23 credited toward their final award pursuant to paragraph 10.40 of the IIP if they make a Track 2 claim (or deemed to have made a Track 2 Box 1 claim pursuant to paragraph 8.10 of the IIP) or paragraph 11.8 of the IIP if they make a Track 3 claim. Interest will be applied once $8,411.23 has been credited towards their final award pursuant to paragraphs 10.41-10.44 and 11.9-11.11 of the IIP.
For each payment of $5,469.85 pursuant to paragraph 2 of this Order, the Defendant will pay to claimants’ counsel an additional 15% of that amount for legal fees, plus applicable taxes (if any), and 10% (inclusive of any applicable taxes) of that amount to the Ontario Class Proceedings Fund or the Fonds d’aide du Quebec. Epiq will be responsible for transferring these amounts every time a payment of $5,469.85 is made to a claimant. Counsel for the claimants will not be entitled to receive any other fees or costs with respect to the payments of $5469.85 (nor with respect to the credit amounts of $8,411.23 described in paragraph 2 of this Order) but will be entitled to fees and/or costs pursuant to paragraph 2.4 of the IIP for Track 2 claims, and paragraph 2.5 of the IIP for Track 3 claims.
The class members listed in Appendix 1, section 2 do not have any placement in administrative segregation of more than 15 consecutive days on or after March 3, 2011. These class members will not receive $5,469.85 or be subject to the process set forth in paragraphs 2 and 3 of this Order. At the time of making a track selection, they will also have to comply with paragraph 8.8 of the IIP.
The class members listed in Appendix 2 filed a claim after November 7, 2022 - the end of the claims period - and before March 7, 2023 - the end of the extended period to make a late claim but have not provided any reasons pursuant to paragraph 7.2 of the IIP that would justify obtaining leave for the filing of a late claim. These claimants shall forthwith be contacted by Epiq via letter and be given 90 days to provide a reason to the Administrator for why they were unable to make a claim by the Claims Filing Deadline pursuant to paragraph 7.1(b) of the IIP. Responses by claimants must be postmarked or received by Epiq within 90 days of the date of the Epiq’s letter (90-day extension).
Counsel for the Parties shall confer with respect to any claimant who provides a reason pursuant to paragraph 5 of this Order for their claim not being filed by the Claims Filing Deadline to determine whether leave will be granted on consent to those claimants to pursue a Track 2 or Track 3 claim, as the case may be. Should the Parties consent to leave being granted, no further Order of this Court shall be required. If the Parties do not consent, the plaintiffs may bring a further motion before these Courts to seek leave for those individual claimants to be granted leave.
Any claimants listed in Appendix 2 who fail to meet the conditions set out in paragraph 5 of this Order will be deemed to have had their motion for leave to bring a late claim dismissed.
Class members listed in Appendix 2, section 1 have at least one placement of more than 15 consecutive days on or after March 3, 2011. These class members will be treated in the same manner as the class members in Appendix 1, section 1, in paragraphs 2 and 3 of this Order if they comply with paragraphs 5 and 6 of this Order and are granted leave to file a late claim pursuant to paragraph 5 above. Epiq will be responsible for transferring the $5,469.85 once it has been informed by the Parties that leave has been granted.
The class members listed in Appendix 2, section 2 have no placement in administrative segregation of more than 15 consecutive days on or after March 3, 2011. If those class members comply with the 90 day extension, pursuant to paragraph 5 of this Order, the Parties will inform Epiq if leave to file those late claims is granted pursuant to paragraph 6 of this Order. Their claim will then proceed in the same manner as the class members in Appendix 1, section 2, in paragraph 4 of this Order.
Claim number 112038 is rejected since it was not submitted by the March 7, 2023 deadline.
For Appendix 1 and Appendix 2, Epiq is responsible for ensuring that the class members listed under the appropriate section of those Appendices. Any corrections necessary to ensure the accuracy of those Appendices will be made by Epiq without the need for further Court approval.
No costs will be awarded to either Party for this consent motion.
