REASONS FOR DECISION
[1] This is a consent motion for the dismissal of a third party action without costs.
[2] On April 15, 2009, the Plaintiff Jeffrey Lipson commenced a proposed class proceeding against Cassels Brock & Blackwell LLP.
[3] Cassels Brock & Blackwell LLP subsequently commenced third party claims against Mintz & Partners, Deloitte & Touche LLP, Glenn F. Ploughman, Shelley Shifman, Prenick Langer LLP, Gardiner Roberts LLP, and the Estate of Ronald J. Farano (Deceased). There were also claims against John Doe individuals, corporations, and partnerships. In the third party proceedings, Cassels Brock & Blackwell LLP sought contribution and indemnity for any amounts it was found to be liable to Mr. Lipson in the main action.
[4] Cassels Brock & Blackwell LLP has not identified and does not intend to identify any of the John Doe defendants.
[5] On March 19, 2013, the main action was certified as a class proceeding.
[6] On November 5, 2020, the third party claim against Deloitte & Touche LLP was dismissed.
[7] On January 7, 2021, the third party claims against Glenn F. Ploughman and Shelley Shifman were dismissed.
[8] On February 14, 2023, I approved a settlement that resolved the main action.
[9] Cassels Brock & Blackwell LLP and the remaining third parties, Mintz & Partners, Prenick Langer LLP, Gardiner Roberts LLP and the Estate of Ronald J. Farano, deceased, have agreed to an Order dismissing the third party action with prejudice and without costs.
