ENDORSEMENT
(Appointment of Locum Court Counsel)
[1] This is a request by Court Counsel, Brian Gover, for the appointment of a Locum Court Counsel to assume his responsibilities with respect to a Request for Direction (RFD) known as Metatawabin RFD #2.
[2] Under the Indian Residential Schools Settlement Agreement (“IRSSA”), I am the Supervising Judge for Ontario (one of nine Supervising Judges) and the Administrative Judge for Eastern Canada.
[3] In March 2007, on consent of the parties, the nine courts with responsibility for the IRSSA issued identical Approval Orders and Implementation Orders. Both the judgments of the courts and the Approval Orders provide that the nine courts shall supervise the implementation of the IRSSA and the judgment and may issue such orders as are necessary to implement and enforce the provisions of the agreement and the judgment. For present purposes, the following terms of the Implementation Order should be noted:
Court Counsel
- THIS COURT ORDERS that Randy Bennett of Rueter Scargall Bennett LLP ("Court Counsel") [now Brian Gover] is hereby appointed legal counsel to and for the Courts to assist the Courts in their supervision over the implementation and administration of the Agreement.
13.THIS COURT ORDERS that Court Counsel's duties shall be as determined by the Courts. Communications between Court Counsel and the Courts shall be privileged.
23.THIS COURT ORDERS that the Courts shall supervise the implementation of the Agreement and this order and, without limiting the generality of the foregoing, may issue such further and ancillary orders, from time to time, as are necessary to implement and enforce the provisions of the Agreement, the judgment dated December 15, 2006 and this order.
[4] In January 2013, by Court Order, after a temporary appointment, Brian Gover was appointed Court Counsel because of the untimely death of Randy Bennett.
[5] On September 22, 2023, I received a letter from Mr. Gover which stated:
Dear Mr. Justice Perell:
Re: Indian Residential Schools Settlement Agreement
Metatawabin Request for Direction #2
I am writing to you in your capacity as Eastern Administrative Judge for the purposes of the Indian Residential Schools Settlement Agreement (“IRSSA”).
The requestors in the Metatawabin Request for Direction #2 (“Metatawabin RFD #2) have sought my disqualification as Court Counsel on the basis that I have acted in a conflict of interest.
Mr. Justice Glustein has been assigned to hear the Metatawabin RFD #2 (and is copied in this correspondence). Metatawabin RFD #2 is the only outstanding RFD. Justice Glustein recently convened a case management conference, and he set a schedule for the exchange of materials and scheduled February 27, 2024 for the hearing of the motion for my disqualification.
In then circumstances, I consider it prudent to request that a Locum Court Counsel be assigned for Metatawabin RFD #2. In my view, these steps are in the interests of a timely determination of the Metatawabin RFD #2, and the administration of justice generally.
[6] I accede to Mr. Gover’s request. I appoint Michael A. Eizenga as Locum Court Counsel to assist Justice Glustein in Metatawabin RFD #2.
