[1] This matter proceeded to a hearing today, by Zoom link, of a s.522(2) bail application by the accused, with the accused, (charged with being an accessory to murder after the fact contrary to section 240 of the Criminal Code), participating by audio while in custody at the local Ontario Provincial Police detachment.
[2] For reasons orally delivered:
a. I am satisfied that the accused has shown cause why her detention in custody is not justified within the meaning of subsection 515(10) of the Criminal Code;
b. The accused is to be the subject of a Form 11 release order made subject to the following terms and conditions:
i. the accused is to promise to pay the amount of $2000.00, (without deposit), if she fails to comply with a condition of the release order;
ii. the accused is to continue to reside at her residence, known by its municipal address as 46293 North Street, Sparta, Ontario; and
iii. the accused is to have no contact or communication, directly or indirectly, with the following individuals:
- William Bain Jr;
- Crystal Doncaster;
- Bogdan Rozhko;
- Brendan Bishop; and
- Richard Bishop.
[3] The matter is adjourned to be spoken to in the Ontario Court of Justice on Tuesday, January 31, 2023, at 9am.
