Costs Endorsement

[1] Following my endorsement of May 9, 2023, and pursuant to my direction, the plaintiff has now provided a Costs Outline which was uploaded to Caselines. The plaintiff is seeking $10,000 inclusive of HST for costs. After reviewing the time spent and the fees allocated to legal fees on a partial indemnity basis of $10,604.81, inclusive of HST and disbursements, I am awarding costs, to the plaintiff in the amount of $9,500.00 all inclusive, which amount is fair and reasonable to the plaintiff. While the fees are generally reasonable and there does not appear to be any duplication, there is time included which should not be visited upon the unsuccessful party. The fixing of costs is not an exact mathematical calculation: see Boucher v. Public Accountants Council for the Province of Ontario. I have reduced some of the clerk’s time for the item “Organize and filing of motion materials”, which appears to be administrative, and for the 0.4 entry as no description is provided. I have also reduced some of the time by Mr. Lester for reviewing my endorsement, preparing for, and attending on a telephone call with me.

[2] The judgment may be submitted to the registrar in accordance with r. 59 for signing.
