[1] This motion for summary judgment was scheduled for today.

[2] The moving party sought a conveyance of real property that was subject to a mortgage as well as a declaration as to a partnership which involved a third party who was not a party to the proceeding.

[3] The responding party raised the issue that the mortgagee and the other listed partner were necessary parties who had not been served.

[4] Yesterday I advised the parties that the matter must be adjourned to address this issue to ensure that the necessary parties were before the Court in respect of the relief claimed.

[5] As well, the materials had not been uploaded to caselines properly. In that regard, there are approximately 3000 pages of materials and the plaintiff had not separately uploaded the exhibits which consisted of dozens and dozens of text exchanges and other documents. This results in the matter being cumbersome to review and is not in accordance with the practice direction. I directed the parties to upload the materials with exhibits separately. As well, I directed them to provide hyperlinks within their factums to the evidence cited.

[6] The matter is adjourned to June 7, 2023 before me at 10:00 am for a full day.
