[1] The Plaintiff brings this consent motion for an Order transferring this action from the City of Newmarket (Central East Region) to the City of Toronto (Toronto Region).

[2] I have reviewed the motion record and applied the factors set-forth in rule 13.1.02 of the Rules of Civil Procedure R.R.O.Reg.194.

[3] I am satisfied that the interest of justice favors transferring this action to the City of Toronto (commercial list) so that Kimmel J. can hear the trial of this action in accordance with the direction given in her endorsement dated October 20,2022.

[4] Order granted transferring this action from the City of Newmarket (Central East Region) to the City of Toronto (Toronto Region) Commercial List. I further direct that a Commercial List Court File Number be assigned.
