ENDORSEMENT

[1] A hearing date for this appeal was fixed for December 2,2022. Pursuant to the Case Conference Endorsement of Justice Ryan Bell dated May 26,2022 responding materials were to be served no later than September 30,2022. It appears responding materials were not filed in accordance with this endorsement.

[2] On November 25,2022 the Respondent, who is now self represented, advised the Court by email that she wishes to respond to this appeal in French and wants to be addressed in French.

[3] Counsel for the appellant and the respondent attended today by Zoom. A French interpreter was sworn in and present. Submissions regarding an adjournment were heard.

[4] The panel advised the parties that the interest of justice require that this matter be adjourned to be heard on the merits by a bilingual panel. The parties are to contact the Ottawa Registrar to obtain a case conference date before Justice Labrosse to set a new hearing date and to address any outstanding timetabling issues.

[5] This endorsement is to be translated into French and forwarded to the parties in English and French.
