ORDER AND DIRECTION
[1] The pleading amendment motion brought by the plaintiff was to have been heard today. Counsel appeared and requested an adjournment because the Public Inquiry is ongoing.
[2] In addition, counsel for certain of the defendants wishes to bring a motion to strike certain portions of the claim but may not be retained to do so until after the pending funding motion.
[3] The court therefore orders as follows:
a) This motion is adjourned to January 24 and 25, 2023, at 10:00 a.m. A motion to strike the pleading or parts thereof may be brought at the same time. Two days will be reserved for the combined motions.
b) Counsel are to agree on a timetable for exchange of materials or seek further guidance from the court if they cannot do so.
c) All material for use on the motions shall be filed in the manner required by the rules and will also be uploaded to CaseLines. The motions will proceed by videoconference.
d) In light of these preliminary motions, the date for scheduling the certification motion is postponed to a date to be set by the court.
e) This order is effective without further formality. It is a case management order pursuant to Rule 50.13, a timetable pursuant to Rule 3 and an order pursuant to s. 12 of the Act.
