ENDORSEMENT
[1] FTI Consulting Canada Inc. in its capacity as Monitor of the Applicants (the “Monitor”) brings this motion for an order extending the Stay Period to November 18, 2023.
[2] The facts in support of the motion, which was not opposed, are set out in the Thirtieth Report of the Monitor dated October 26, 2022 (the “Thirtieth Report”).
[3] I am satisfied that the Thirtieth Report establishes that the parties have been and continue to work in good faith and with due diligence such that the extension should be granted. The required Cash Flow Forecast has been filed which indicates that the Applicants have sufficient liquidity to conduct their affairs during the extension of the Stay Period.
[4] The litigation as between the Litigation Trustee and the professional firms has been ongoing for several years and is currently being case managed by Justice McEwen. The parties have indicated that they are making progress with respect to documentary production and they will be in a position to provide an update with respect to such production by the end of March 2023. I encourage the parties to cooperate in establishing a timetable which will ensure that the trial of this matter can be scheduled.
[5] In order to ensure a degree of supervision on this file, in my view it is more appropriate to extend the Stay Period to April 3, 2023 as opposed to the requested date of November 18, 2023.
[6] The Stay Extension is therefore granted to April 3, 2023 and a hearing is to be scheduled before me on that date at 9:00 a.m.
