ENDORSEMENT

[1] On March 2, 2022, I approved the certification of this proceeding for settlement purposes, and I approved the settlement agreement entered into between the plaintiffs and defendant.

[2] The settlement envisioned an independent review to identify affected class members who would be entitled to notice of the settlement.

[3] The plaintiffs seek approval of the long-form notice and short-form notice which they intend to distribute according to the notice plan, which plan I have already approved.

[4] I am satisfied with the content of the notices. They are in plain language and clearly communicate to the affected class members the requirements of participating in the settlement, how to opt-out and the consequences of so doing.

[5] Counsel seeks an order allowing them to distribute the notices in English only, as the defendant only provided services in English. This is appropriate. There is no need to incur translation expenses when the affected class members would have delivered or received the defendant’s services in English only.

[6] Order to go in accordance with the draft I have signed.
