CASE CONFERENCE
[1] Counsel for the parties in these five actions came together in a case conference before me in an effort to somehow rationalize or coordinate the litigation of what appear to be factually related claims.
[2] I hasten to add that in characterizing them in this way I am simply repeating what I heard from some of the counsel present. At this stage I am making no judgement about whether they really are related in any meaningful way, or whether they should be tried together, separately, serially, etc. I have not even been forwarded a complete set of pleadings to read.
[3] That said, even a brief glance at the five styles of cause indicates that there are repeat and overlapping parties in the various actions. As is obvious from the court file numbers, two of the actions are regular civil matters while three of them have been issued on Commercial List.
[4] All counsel were of the view that these actions should be case managed together. Again, that does not mean that counsel agree that they be joined or tried together; that is a matter of some controversy that may be the subject of a motion down the road. But counsel do all agree that the case management function would more efficiently carried out, and the various procedural and coordination issues that may arise would be more expeditiously handled, if the same case management judge were seized of all of them.
[5] At the case conference, I indicated to counsel that I would be willing to be the case management judge for all five cases. Of course, that would require moving the three Commercial List actions into regular Civil actions. Counsel all appeared to be in agreement with that approach.
[6] I understand that today there is a case conference for at least one of the Commercial List actions. The parties will be before Cavanaugh J. Counsel indicated that they would advise Justice Cavanaugh of this development, and presumably will start to make arrangements for having the Commercial List matters transferred to Civil.
[7] The next case conference before me has been scheduled for March 7, 2022 for one and a half hours. Counsel on all of the five actions are invited to attend.
