[1] I had my assistant send counsel an email earlier this week to advise counsel that as I am involved in a criminal trial, there would be a need to be efficient and concise at today’s hearing. Despite this, as of 9:40 a.m., Mr. Mangat did not appear. Mr. Mangat was also late more than once during this trial.
[2] In the absence of Mr. Mangat, I am reluctant to proceed. I will adjourn today’s hearing to June 14, 2022 at 9:00 a.m. by videoconference
[3] I confirm that the PGT will not be required at that hearing. I thank Ms. Filgiano for providing the PGT’s statement of law.
[4] Mr. Chahal advises that counsel did reach an agreement as to who the capacity assessor would be and how a capacity assessment would be funded if I order a capacity assessment. If the parties can reach an agreement with respect to the capacity assessment issue, counsel are asked to write me (via email to judicial assistant, Linda Thompson, in Owen Sound) so that I can assess next steps.
