SUPERIOR COURT OF JUSTICE – ONTARIO – DIVISIONAL COURT
RE: David v. Law Society of Ontario
COUNSEL: Mr David, self-represented David LeMesurier, for Law Society of Ontario Daniel Mayer, for Attorney General of Ontario
BEFORE: D.L. Corbett J.
DATE: February 4, 2021
CASE MANAGEMENT ENDORSEMENT
D.L. Corbett J.
[1] This endorsement reflects a case management teleconference held February 4, 2021.
[2] On consent, the application is dismissed as against the Attorney General of Ontario without costs.
[3] The applicant sought a stay of proceedings on motion to a member of the Appeal Panel. Decision on that motion was reserved in January 2021. On consent, this application is stayed pending decision on the motion currently under reserve by the member of the Appeal Panel. Either side may seek further directions from this court after the stay decision has been released.
[4] The Law Society takes the position that, if the stay is denied by the member of the Appeal Panel, the appeal should proceed before the Appeal Panel, and only after decision on the appeal itself would a further appeal lie to this court; to pursue review of the stay decision in this court would be premature. This argument may be revisited when the court is next asked to give directions in this matter.
[5] Order to go staying this application until further direction of an administrative judge of the Divisional Court pursuant to this direction.
Date: February 4, 2021
