[1] On December 1, 2020, Ferguson J. scheduled several motions by the Defendants to be heard on March 1, 2021.
[2] In an endorsement dated January 6, 2021, I advised the Plaintiff:
…In case there was any confusion as to the manner of contacting the court, the parties are notified that I am not to be contacted except in accordance with Rule 1.09. I will not respond further to unilateral, uninvited correspondence.
Requests for hearings and case conferences may be made in the manner set out in Part C, Section C.1.1 of the Notice to Profession – Toronto, Toronto Expansion Protocol for Court Hearings During COVID-19 Pandemic, Notice of amendments: Effective December 1, 2020 that can be found online at https://www.ontariocourts.ca/scj/notices-and-orders-covid-19/notice-to/#C_Civil_Matters
[3] In an email dated today, the Plaintiff wrote to the Civil Trial Coordinator’s Office, Ferguson J., and her Judicial Assistant.
[4] The plaintiff’s email is not a motion for an adjournment brought in accordance with the Notice to the Profession referred to in para. 11 of my prior endorsement and quoted above. It has no effect on the current motion schedule ordered by Ferguson J.
[5] No further communication from the Plaintiff in contraventions of R 1.09 of the Rules of Civil Procedure, RRO 1990, Reg 194 will be acknowledged or acted upon.
