ENDORSEMENT
[1] This is an Application for the partition and sale of a house owned by the Applicant and Respondent. The Applicant requests this case conference to schedule the Application and to establish a timetable. The Respondent is self-represented. She did not attend the case conference. Counsel for the Applicant advised that the Respondent is reportedly ill with long Covid-19.
[2] Counsel for the Applicant states that the Respondent repeatedly agreed in writing to sell the house but failed to implement the sale and has not complied with a settlement agreement signed in July 2018. He argues that it is necessary to proceed with the Application.
[3] I schedule the Application for March 28, 2022 for less than two hours. This should provide sufficient time for the Respondent to retain counsel and prepare materials for the Application. If she intends to retain counsel, the Respondent is directed to do so by January 31, 2022. I establish the following timetable for the Application:
Applicant to deliver the Application Record by December 15, 2021;
Respondent to deliver the Responding Record by January 31, 2022;
Cross-examinations, if any are to be completed by February 15, 2022;
Factums shall be delivered in accordance with the Rules of Civil Procedure.
[4] I direct counsel for the Applicant to deliver a copy of this endorsement to the Respondent.
[5] I remain seized with respect to any procedural matters that may arise, including any request by the Respondent to vary the timetable. I am not seized of the Application.
