ENDORSEMENT

[1] The Applicant, Samira Altwal brought this Application for an order to recover money she states that her brother, Suhail Karadsheh removed from her banking account and which he put into an account over which he had exclusive control. On February 1, 2020 the parties entered into settlement discussions. The Applicant entered into a settlement agreement with Suhail and their brother, Elias Karadsheh. The settlement provided that Suhail and Elias would pay back a certain amount of money to the Applicant. Suhail paid some money to Harry Sarros, counsel for the Applicant. Elais did not pay any money to Mr. Sarros.

[2] The parties agreed to settle this matter on the basis that the amount paid to the trust account of Mr. Sarros will be accepted by the Applicant in full settlement of her claim against Suhail and Elias. The Applicant brings this motion for a final order confirming the parties’ consent to settle the Application.

[3] By endorsement dated January 10, 2021, I refused to grant the order requested and directed the Applicant to file additional material. On January 18, 2021, I received additional material from Counsel for the Applicant. By endorsement dated January 18, 2021, I adjourned the matter to allow the Applicant to file the Consent executed by counsel of record for the Applicant. On January 25, 2021, I received the consent executed by Chiara Yousef, the counsel of record for the Applicant.

[4] I am satisfied the parties consent to the order sought. Order to go in accordance with the draft order filed and signed by me.
