ENDORSEMENT
[1] In my decision of September 10, 2021 I invited counsel for the parties to deliver written submissions on costs if that subject could not be agreed upon by them. I now have received and considered submissions from both parties.
[2] In my view, the subject matter of the motion brought in writing was not appropriate for determination in that manner due to the issues raised by the responding party and therefore the motion was traversed to be heard and determined in open court.
[3] In all of the circumstances, I consider that the most fair and reasonable disposition of costs of the motion before me is to reserve that issue for determination by the judge who presides at the motion when brought before the Court, and I so order.
