ENDORSEMENT

[1] The parties entered into Minutes of Settlement in January 2021. As security for the payment to be made pursuant to the settlement, the Defendant executed a consent to judgment in favour of the Plaintiff in the amount of $39,000, less any payments made to the date of the default, plus costs.

[2] The Defendant defaulted under the terms of the Minutes of Settlement. The Plaintiff seeks judgment in the amount of the Consent Judgment less $1,000, which was the amount the Defendant paid towards the settlement before default. The Plaintiff seeks its costs in the amount of $320.

[3] I am satisfied that the Plaintiff is entitled to Judgment in the amount of the Consent Judgment less the amount paid of $1,000. I find the amount claimed by the Plaintiff for costs of $320, is fair and reasonable in all of the circumstances.

[4] Order to go in accordance with the draft consent judgment filed and signed by me.
