ENDORSEMENT

[1] The Plaintiff intends to bring a motion to order the sale of the subject property. The Defendants, Ashgar, Chaudhary and 2425779 Ontario Inc. do not necessarily object to the sale of the property but there is no agreement as to the terms of the sale.

[2] I schedule the motion for November 1, 2021 for a half day. I am seized. The following timetable is established:

Plaintiff’s motion materials to be delivered by August 25, 2021;

Responding materials to be delivered by September 16, 2021;

Cross-examinations to be completed by October 6, 2021;

Plaintiff’s factum to be delivered by October 18, 2021; and

Responding factum to be delivered by October 28, 2021.

[3] It is my view that the parties would benefit from a case conference after the exchange of the motion records and cross-examinations. I schedule the case conference to be before me on October 8, 2021 at 9 a.m. On the case conference, I will identify the issues that remain contested and explore methods to resolve the contested issues. If the issues cannot be resolved, the motion will proceed as scheduled on November 1, 2021.
