ENDORSEMENT

[1] The Plaintiff brought a motion for an order transferring the Small Claims Court Action, action no.: SC-15-7300-00 to Superior Court and to have the action consolidated with this action. By endorsement dated December 11, 2020, I granted the relief sought. The endorsement provides that the Small Claims Court action is transferred to the Superior Court of Justice to be consolidated or tried together with this action.

[2] A draft order was provided to me. I signed the order on December 22, 2020. The order states that the two actions are to be tried together. The draft order did not provide that the actions are to be consolidated.

[3] The Plaintiff seeks to vary my order dated December 22, 2020 to specifically provide that the two actions are to be consolidated. The Defendant consents to the relief sought.

[4] I am satisfied that it is necessary to vary my order, so it more accurately conforms with the endorsement. I vary the order to provide that the two actions are to be consolidated.

[5] Order to go in accordance with the draft order filed and signed by me.
