ENDORSEMENT

[1] The Defendant, Great Lakes Nickel Limited (“GLN”) brings this motion in writing for an order directing that the money it paid into court pursuant to consent and/or unopposed court orders be paid back to GLN. The motion is opposed by the Plaintiffs.

[2] Pursuant to R. 37.12.1(4)(c) opposed motions may be brought in writing, where the issues of fact and law are not complex, unless the court orders otherwise. I reviewed the material and it is my view that the court would benefit from oral submissions.

[3] I adjourn this matter to a date to be arranged for an oral hearing. Counsel are directed to contact the motions co-ordinator to arrange the hearing for a date I am available. A two-hour appointment should be sufficient.

[4] I remain seized.
