ENDORSEMENT
1The Defendant, Great Lakes Nickel Limited (“GLN”) brings this motion in writing for an order directing that the money it paid into court pursuant to consent and/or unopposed court orders be paid back to GLN. The motion is opposed by the Plaintiffs.
2Pursuant to R. 37.12.1(4)(c) opposed motions may be brought in writing, where the issues of fact and law are not complex, unless the court orders otherwise. I reviewed the material and it is my view that the court would benefit from oral submissions.
3I adjourn this matter to a date to be arranged for an oral hearing. Counsel are directed to contact the motions co-ordinator to arrange the hearing for a date I am available. A two-hour appointment should be sufficient.
4I remain seized.
