SUPERIOR COURT OF JUSTICE - ONTARIO
RE: WILL MORRIS, Plaintiff
– and –
SOLAR BROKERS CANADA CORP., JEAN CLAUDE AWWAD AND JOSEPH BARKER, Defendants
BEFORE: E.M. Morgan J.
COUNSEL: Alexandra Monkhouse and Andrew Monkhouse, for the Plaintiff
Jean Claude Awwad, on his own behalf
HEARD: June 23, 2021
cASE CONFERENCE
1Two of the three Defendants are in default. Jean Claude Awwad is the remaining Defendant. He is now representing himself.
2Counsel for the Plaintiff has suggested that this action would benefit from a timetable for the next steps. Mr. Awwad indicates that he does not object to a timetable but would like a bit of extra time as he is operating without the assistance of a lawyer.
3Mr. Awwad has suggested the following dates, which appear reasonable to me. The parties shall proceed as follows:
Affidavits of documents by August 22, 2021;
Discoveries completed by November 22, 2021; and
Pre-trial sometime in March 2022
4Since I was the certification judge and have been case managing this matter, it is advisable for another judge to conduct the pre-trial. Any exploration of settlement might benefit from having a fresh pair of eyes, as it were, looking at it. For the pre-trial, either or both sides are to contact my assistant in late February or early March 2022 to make arrangements for another judge to conduct a pre-trial session.
Morgan J.
