ENDORSEMENT
[1] On June 7, 2021, the applicant Julie Tremblay appeared before me to take part in a case conference. The applicant was represented by Julie Lassonde.
[2] The respondent Franck Hermann Ayosso did not appear. Ms. Lassonde submitted proof of service on the respondent. Her written memorandum described several attempts to communicate with Mr. Ayosso before the conference. The respondent never replied to her. He has not served any documents in this case. No answer has been filed.
Background and Important Facts
[3] The parties began cohabiting in October 2005. They never married. They separated on March 29, 2020. They had four children together: M, who is 15 years old; P., who is 12 years old; K., who is nine; and Y., who is seven.
[4] Since the date of separation, the children have lived with the applicant. She makes all decisions concerning them and provides them with all the care they need.
[5] The respondent owns the family residence.
[6] The respondent is facing criminal charges for an incident that occurred at the time of the separation. The applicant had been injured in the past. Her affidavit, introduced at the case conference, states that she and the children are afraid of the respondent.
[7] The respondent’s bail conditions in the criminal case prevent him from communicating with the applicant, except through two third parties, one of whom is the applicant’s lawyer, for the purpose of obtaining parental time with the children or participating in family law proceedings. The respondent is not allowed to communicate with the applicant, directly or indirectly, and is not allowed to be within 500 metres of the family residence at 66 Valley Centre Drive, Toronto, or to enter premises where the applicant is.
[8] Services such as heat, electricity and Internet have not been cut off in the family residence. The applicant assumes that the respondent is continuing to pay those expenses.
[9] The respondent has not spoken to his children and has not seen them in over a year.
Interim Relief Sought at the Case Conference
[10] The applicant proposes that the Court make an uncontested temporary order on the issues that can be disposed of at this stage. Those issues include child support, the children’s residence, decision-making responsibility for the four children, the disclosure of information (including information in Ms. Tremblay’s possession), the preservation of property, costs, and setting a date for an uncontested trial.
[11] According to the respondent’s 2018 notice of assessment, his income is $76, 699. Based on that income, the appropriate support for four children is $1,815 per month.
[12] Once the respondent has made financial and other disclosure, the Court will be able to make a final order on all issues. They include arrears of child support from March 29, 2020, to June 30, 2021, interest owed on that amount, the obligation to pay special expenses, and the request for a restraining order.
Family Law Rules
[13] The applicant is asking the Court to apply Rule 17(8) of the Family Law Rules, O. Reg. 114/99, as the basis for the temporary orders sought.
[14] Rule 17(8) provides:

(8) Lors d’une conférence relative à la cause, d’une conférence en vue d’un règlement amiable ou d’une conférence de gestion du procès, le juge peut, si cela est approprié :
a) rendre une ordonnance de divulgation de documents (règle 19), d’interrogatoire (règle 20) ou de dépôt des résumés des plaidoiries dans le cadre d’une motion, fixer les date et heure des étapes de la cause ou donner des directives pour la ou les prochaines étapes de la cause;
a.0.1) rendre une ordonnance au sujet d’un témoignage d’opinion d’expert, notamment :
(i) l’engagement d’un expert par ou pour une ou plusieurs parties,
(ii) l’utilisation des témoignages d’opinion d’expert dans une cause,
(iii) la remise, la signification ou le dépôt des rapports d’experts ou des opinions écrites;
a.1) rendre une ordonnance exigeant que les parties déposent un protocole de gestion du procès ou un protocole d’établissement du calendrier du procès présenté selon la formule déterminée par le tribunal;
b) rendre une ordonnance exigeant qu’une ou plusieurs parties participent :
(i) soit à un programme d’information obligatoire,
(ii) soit à une conférence relative à la cause ou une conférence en vue d’un règlement amiable présidée par une personne nommée aux termes du paragraphe (9),
(iii) soit à une réunion initiale avec un service de médiation affilié à un tribunal,
(iv) soit à un programme offert par l’intermédiaire de tout autre service ou de toute autre ressource communautaire existant;
b.1) si un avis a été signifié, rendre une ordonnance définitive ou une ordonnance temporaire, notamment n’importe laquelle des ordonnances temporaires suivantes, pour faciliter la sauvegarde des droits des parties jusqu’à la conclusion d’un autre accord ou au prononcé d’une autre ordonnance :
(i) une ordonnance relative à la désignation des bénéficiaires d’une police d’assurance-vie, d’un régime enregistré d’épargne-retraite, d’une fiducie, d’une pension, d’une rente ou d’un instrument financier semblable,
(ii) une ordonnance préservant tout ou partie des éléments d’actif de celui-ci,
(iii) une ordonnance interdisant la dissimulation ou la destruction de documents ou de biens,
(iv) une ordonnance exigeant la comptabilisation des fonds dont une des parties a le contrôle,
(v) une ordonnance maintenant la garantie d’assurance-santé et soins médicaux pour une des parties et les enfants de la relation,
(vi) une ordonnance maintenant le versement des paiements périodiques nécessaires pour préserver un élément d’actif ou une prestation destinée à une des parties et aux enfants;
c) rendre une ordonnance non contestée ou une ordonnance sur consentement;
d) sur consentement, renvoyer toute question en litige pour règlement extrajudiciaire. Règl. de l’Ont. 114/99, par. 17 (8); Règl. de l’Ont. 202/01, par. 5 (3) et (4); Règl. de l’Ont. 89/04, par. 8 (3); Règl. de l’Ont. 6/10, par. 7 (5); Règl. de l’Ont. 383/11, par. 4 (3); Règl. de l’Ont. 322/13, art 10; Règl. de l’Ont. 69/15, par. 6 (1); Règl. de l’Ont. 250/19, par. 5 (1).

[15] I have taken into account the fact that the children live with the applicant, that I may deduce from the evidence that the respondent has paid to maintain the family home, and that he received notice of the applicant’s motion and of the case conference.
Conclusion
[16] The Court will exercise its jurisdiction in this matter: it will decide the interim issues, based on the completed documents filed, in the absence of a response from the respondent, and pursuant to Rule 17 of the Family Law Rules.
[17] I order that, temporarily:
The applicant will have sole decision-making responsibility concerning the four children.
The four children will reside with the applicant.
The respondent’s income as shown in his 2018 notice of assessment is $76,699 and, based on that income, the respondent will pay monthly child support in the amount of $1,815, on the first of every month commencing on July 1, 2020.
The applicant shall produce the respondent’s 2016 and 2018 notices of assessment and the Ayos Global Force Corporation financial statements (balance sheet and statement of income and expenses) for 2016, 2017 and 2018 by June 30, 2021.
The respondent shall produce the following by July 31, 2021:
a. Copies of all his personal and business bank statements, including the bank statements for his company Ayos Global Force Corporation, since January 2018;
b. Monthly rental income reports, both personal and for his company Ayos Global Force Corporation, since January 2018;
c. Financial statements for his company Ayos Global Force Corporation for 2019 and 2020;
d. Complete copies of his income tax returns and the income tax returns for his company Ayos Global Force Corporation (T1 or detailed notices of assessment from Revenue Canada), including all supporting documents, for 2017, 2018, 2019 and 2020.
The respondent shall produce valuations of the buildings owned by him personally, of his company Ayos Global Force Corporation, and of the buildings owned by that company, and provide those valuations by July 31, 2021.
The respondent shall preserve all property in his possession or under his direct or indirect control.
The respondent is prohibited from concealing, wasting, transferring, mortgaging or otherwise dissipating the property in his possession or under his direct or indirect control.
The respondent is prohibited from concealing or destroying documents relating to the property in his possession or under his direct or indirect control.
This case is an uncontested case and the uncontested trial date is set for October 25, 2021, for one day.
If necessary, the applicant may bring urgent motions relating to parental time and a restraining order.
The respondent shall pay the costs of this case conference, by paying the sum of $2,000 to Legal Aid Ontario.
