CASE CONFERENCE ENDORSEMENT
[1] Plaintiff’s counsel is in the process of arranging a motion date to remove himself as solicitor of record as he has apparently lost touch with his client. For this reason, he would like the upcoming June 2021 trial date vacated and the trial eventually rescheduled when he is off the record.
[2] Defendant’s counsel does not want to lose the trial date. They were prepared to bring a motion to dismiss this past year, but held off doing so due to Plaintiff’s counsel’s attempts to get off the record. They are not interested in any further delay.
[3] I am not prepared to vacate the trial date. If Defendants’ counsel are so inclined, they may bring their motion to dismiss at the outset of trial. At that point, Plaintiff’s counsel can explain his predicament to the trial judge who will be in a position to decide what to do.
