ENDORSEMENT

[1] The Applicant, 2390880 Ontario Ltd. brings this Application for payment of invoices. At the case conference on April 20, 2021, I scheduled the Application for August 11, 2021 for a three-hour appointment. I adjourned the case conference to today to allow the Respondent time to retain counsel to represent the corporation in accordance with R. 15.01(2).

[2] The Respondent did not attend the case conference today. Counsel for the Applicant advised that she sent the call-in numbers for the case conference to all three of the Respondent’s e-mail addresses but did not receive a response. The case conference proceeded in the absence of the Respondent.

[3] The following timetable for the Application is established:

i. The Respondent must retain counsel by June 21, 2021;

ii. The Applicant’s record has already been delivered;

iii. The Respondent’s record to be delivered by July 16, 2021;

iv. Cross-examinations to be completed by July 23, 2021;

v. Applicant’s factum to be delivered by July 30, 2021;

vi. Respondent’s factum to be delivered by August 6, 2021; and

vii. Hearing on August 11, 2021 for three hours.

[4] Counsel for the Applicant is directed to deliver a copy of this endorsement to the Respondent forthwith, and to provide the Respondent with the call-in information for the Application when received from the court.
