[1] By endorsement dated December 3, 2020, Justice Pinto scheduled the Plaintiff’s motion for February 22, 2021. The motion was scheduled for a half day. The motion was adjourned on consent as a result of a personal emergency of the Defendant’s counsel. A chambers appointment was requested to schedule a new date for the hearing of the motion.
[2] On consent the motion is scheduled for August 20, 2021. The parties have exchanged their motion records. The following timetable for the remaining steps is established on consent:
Cross-examinations and R. 39 examinations shall be completed by July 9, 2021;
Undertakings from the examinations to be answered by July 15, 2021;
Plaintiff’s factum to be delivered by August 6, 2021;
Responding party’s factum to be delivered by August 13, 2021;
Plaintiff’s reply factum, if any to be delivered by August 17, 2021.
[3] I remain seized with respect to any issues involving the timetable set out above.
