1By endorsement dated December 3, 2020, Justice Pinto scheduled the Plaintiff’s motion for February 22, 2021. The motion was scheduled for a half day. The motion was adjourned on consent as a result of a personal emergency of the Defendant’s counsel. A chambers appointment was requested to schedule a new date for the hearing of the motion.
2On consent the motion is scheduled for August 20, 2021. The parties have exchanged their motion records. The following timetable for the remaining steps is established on consent:
Cross-examinations and R. 39 examinations shall be completed by July 9, 2021;
Undertakings from the examinations to be answered by July 15, 2021;
Plaintiff’s factum to be delivered by August 6, 2021;
Responding party’s factum to be delivered by August 13, 2021;
Plaintiff’s reply factum, if any to be delivered by August 17, 2021.
3I remain seized with respect to any issues involving the timetable set out above.
