[1] On January 26, 2021, Myers, J. convened a case conference to schedule either a summary judgment motion, or summary trial in this wrongful dismissal action. The Defendant does not allege dismissal for cause. The issues to be determined at trial include the length of service, whether there is an enforceable termination provision in the employment contract, mitigation, the payment of a bonus, and other damages.

[2] The parties agree that this matter should proceed by way of a summary trial. I schedule the summary trial for the week of September 20, 2021. The trial is scheduled for 2 days.

[3] On consent, I establish the following timetable:

a) Affidavits of Documents to be exchanged by March 31, 2021; b) Examinations for discovery completed by May 31, 2021; c) Undertakings answered by June 15, 2021; d) Pre-trial/settlement conference on June 16, 2021 at 9 a.m.; e) Plaintiff’s affidavits of their witnesses’ evidence in-chief to be delivered by July 20, 2021; f) Defendant’s affidavits of their witnesses’ evidence in-chief to be delivered by August 20, 2021; g) Plaintiff’s factum to be delivered by September 10, 2021; h) Defendant’s factum to be delivered by September 17, 2021; and i) Summary trial the week of September 20, 2021.

[4] I am seized of this matter for the purposes of conducting the pre-trial conference on June 16, 2021 and any issues that may arise with respect to the timetable.
