[1] On January 18, 2021 Myers, J. convened a case conference to consider scheduling the Defendant, Shao’s motion for directions.
[2] The parties entered into a Consent Order on October 26, 2020, permitting the sale of the property located at 3336 Bethesda Road, Stouffville. The Property was owned by Li Ping Shao. The Order provides that the net proceeds of the sale shall be held by Devry Smith Frank LLP, in trust and shall be disbursed on the consent of the Plaintiffs and Ms. Shao or further Order of the court.
[3] The property sold on January 11, 2021. The proceeds of sale are $1,617,094. Shao is seeking an Order that $130,587.61 be paid out of the amount held in trust to her for payment of living expenses and legal fees. The Plaintiff opposes the motion.
[4] The motion is scheduled for March 29, 2021 for 2 hours. I establish the following timetable on consent:
a) Moving party to serve the motion record by March 8, 2021; b) The Plaintiff to serve the responding motion record by March 15, 2021; c) Cross-examinations completed by March 19, 2021; d) Moving Party factum served by March 23, 2021; e) Plaintiff’s factum served by March 26, 2021; and f) Hearing March 29, 2021.
[5] I am not seized of this matter.
