ENDORSEMENT
[1] I granted the defendants’ motion for production of documents [2020 ONSC 148]. The defendants now ask for costs.
[2] In my reasons for decision I said this:
The requests for disclosure were basic, relevant and proportionate to the claim. Although the parties never agreed to a disclosure plan, it is by now long since past the time that these basic requests should have been answered. It is also obvious that not much would have been forthcoming if the defendants had not brought the motion. I exercise my discretion to order production.
[3] The defendants had to bring the motion to get the production to which they were entitled, including production that the defendant had undertaken to give. The defendants were successful and should be partially indemnified. I fix costs at $2,500 and order the plaintiff to pay that amount to the defendants within 31 days.
