SUPERIOR COURT OF JUSTICE - ONTARIO
RE: Eyelet Investment Corp. c.o.b. Treasure Hill Homes, Appellant
AND:
Li (Lily) Song, Bo Xiao, Dong Mei Zhao, Mesfin Yersaw and Ekaterina Amkha, Respondents
BEFORE: Madam Justice O’Brien
COUNSEL: Stephen Brunswick, Jennifer J. Lake, Harvin D. Pitch, for the Appellants Lily Song, Self-Represented Ekaterina Amkha, Self-Represented Bo, Xiao, Self-Represented Dong Mei Zhao, Self-Represented Mesfin Yersaw, Self-Represented
HEARD:
ENDORSEMENT
[1] I have received submissions from the parties with respect to the form of the Order in this matter. Counsel for the Appellant has provided a draft Order addressing my judgment on the appeal as well as my costs endorsement.
[2] The law firm previously representing the Respondents approved the Order, but subsequently was told it did not have authority to do so.
[3] I then gave the individual Respondents the opportunity to provide any submissions with respect to the Order. By letter dated June 19, 2020, the Respondents wrote that “while we approve the form of the Order prepared by [counsel for the Appellant], we have some concerns to communicate.” I have reviewed the concerns, and they do not relate to the form or content of the Order.
[4] Nonetheless, the Appellant provided responding submissions and the Respondent then sent further submissions. The Respondents may choose to seek legal advice with respect to the concerns they have raised in their submissions and/or engage in discussions with the Appellant specifically with respect to their concern about a schedule for the payment of costs.
[5] The Respondents have asked for my guidance and direction regarding how to raise their concerns in the appropriate forum. I am not able to provide them with legal advice but can suggest they seek advice from a lawyer with respect to their concerns.
[6] As these issues do not impact the form and content of the Order, I have signed the Order, in the form provided, with the addition of a provision about the Order being enforceable without the need for formal entry and filing.
