[1] This is my ruling on the issue of costs arising from the motion on which I released my reasons on the merits on October 14, 2020.
[2] The Applicant seeks costs of $2073.06. The Respondent seeks costs of $17,500.00.
[3] The Respondent is entitled to costs to compensate her for costs consequent on the amendment to the Application which I permitted.
[4] She was, however, unsuccessful on the disclosure portion of the motion.
[5] Neither party obtained the advance of funds sought.
[6] Further, I have considered the offers of the parties.
[7] In all of the circumstances I am satisfied that a just order would be to grant the Respondent costs of $3000 payable by the Applicant within 30 days of release of this endorsement, and I so order. The sum of $ 3000 is inclusive of fees, disbursements, and applicable taxes.
