ENDORSEMENT
[1] This matter arises from an appeal by Patrick Robertson (the “Appellant”) of the decision of the Consent and Capacity Board (“CCB”) dated October 1, 2019, confirming a finding of incapacity with respect to consenting to or refusing treatment with antipsychotic medication.
[2] Counsel for the Respondent Dr. Ashwati Raghunath (the “Respondent”) makes a request that amicus curiae be appointed in this matter as the Appellant has failed to take the necessary steps to perfect the appeal.
[3] I have reviewed the evidentiary record before me. I am satisfied that the appointment of amicus curiae as a friend of the Court, is appropriate in the circumstances pursuant to Rule 13.2 of the Rules of Civil Procedure, R.R.O. 1990, Reg. 194 (the “Rules”) and the inherent jurisdiction of the Superior Court: R v. Imona-Rusell, 2013 SCC 43, 2013 S.C.C. 43.
[4] As requested, I appoint Maya Kotob as amicus curiae. Order to issue in accordance with the original signed by me today.
[5] I direct that counsel for the Respondent provide a copy of this endorsement and issued and entered Order to the Appellant, Legal Aid Ontario and Maya Kotob.
