Addendum to Cost Endorsement

Background
On May 8, 2020, I released a ruling granting an interlocutory injunction to the applicant. In that ruling I requested written submissions with respect to costs and established a timetable for delivery of those submissions. The submissions of the respondent were due on or before May 22, 2020. The respondent did not file any submissions regarding costs. Accordingly, I proceeded to fix the applicant’s cost of the motion. My Cost Endorsement was released on June 12, 2020.
2After my Cost Endorsement was released, it came to my attention that the respondent had not received my original ruling. I therefore temporarily stayed enforcement of the cost award and granted the respondent until June 24, 2020 to file responding cost submissions. The cost submissions have now been received.

Analysis
I have considered the submissions by the respondent with respect to the costs of the applicant. The respondent’s position is that there should be no costs awarded to the applicant.
4Unfortunately, the respondent’s cost submissions are primarily a repetition of the submissions he made on the hearing of the injunction motion. I found the respondent’s submissions to be unhelpful to me in determining the appropriate quantum of costs to be awarded to the applicant.
5Although I have considered the respondent’s written cost submissions, I am not convinced that my original cost ruling should be revised.

Disposition
For these reasons, my Cost Endorsement is confirmed and the temporary stay of enforcement of that cost award is lifted.
