COSTS ENDORSEMENT

[1] This is my ruling on the matter of costs arising from the motion decided by my order of May 20, 2020.

[2] The Applicant seeks costs of $8487.10 based on her success on the motion.

[3] The Respondent argues that no order as to costs ought to be made. He relies on multiple allegations of improper conduct by the Applicant.

[4] In making my order as to costs, I am taking into account the substantial success of the Applicant on the motion, the bitter and acrimonious nature of the interactions between the parties leading up to the motion and its argument, and the limited means of the parties during the pandemic. In so doing I have regard to FLR 24 and, in particular, FLR 24(1) and 24 (12)(a)(i).

[5] Accordingly, I award the Applicant partial indemnity costs of $5000 inclusive of fees, disbursements, and applicable taxes. Those costs are payable by the Respondent within 60 days.
