COSTS ENDORSEMENT

[1] This is my ruling on costs arising from my order of May 25, 2020.

[2] The Applicant seeks partial indemnity costs of $3613.74 from April 30, 2020 to May 15, 2020 and costs of $500.00 for submissions on the costs issue. He bases his argument on success on the motion.

[3] The Respondent argues that no order as to costs should be made; alternatively, she argues that costs on the motion should be reserved to the trial judge; in the further alternative, she argues that any costs awarded to the Applicant should be offset against child support arrears owed by him. She also argues that her limited means should be taken into account in any costs order made.

[4] In setting the costs in this matter, I have regard to the substantial success of the Applicant, and the limited means of the Respondent. Accordingly, I fix costs at $3500.00 inclusive of fees, disbursements, and applicable taxes; they are payable by the Respondent to the Applicant within 60 days.
