[1] The defendant Certas moves, in writing, for an order requiring the Ontario Provincial Police and the Ministry of the Attorney General to produce copies of their records relating to the investigation of the motor vehicle accident which is the subject of this proceeding.
[2] The O.P.P. have advised that they do not oppose the motion, provided that the resulting order incorporates certain terms to protect the privacy interests of the parties involved. However, counsel for Certas has received no response to the motion from the Crown Law Office (Civil). As this is uncharacteristic, I am concerned with the efficacy of the service effected.
[3] The affidavit of service indicates that a copy of the motion record was mailed to 720 Bay Street, 8th Floor, Toronto, but does not indicate to whom the envelope was addressed. In any event, during the currency of the Covid-19 emergency, all civil proceedings, including WAGG motions, are to be served on the Crown by sending a copy by email to cloc.reception@ontario.ca.
[4] The Crown Law Office (Civil) must therefore be served with a copy of the motion record by email to that address.
