[1] Following the release of my costs endorsement, counsel for the plaintiff wrote to the Court asking that I reconsider parts of my decision on costs as he argues that I omitted to deal with elements of his clients’ discovery requests.
[2] However, I did assess the costs of the plaintiffs’ motions for further discovery. This should have been apparent from paragraphs 4 (a) and 10 of my written reasons. I did not deal with these more specifically because they were not as much the focus of the arguments on costs raised by the unsuccessful defendants.
[3] In any event, in my earlier decision and analysis, I regrouped all production issues under one title and dealt with the costs of all of these under that title.
[4] There is therefore no need to receive further submissions or to reconsider my earlier decision on costs. It deals with the costs of all motions argued earlier before me in this matter.
