[1] The Case Conference proceeded today pursuant to my prior Order of May 7, 2020.
[2] The issues before the court were child support and disclosure.
[3] I have reviewed the Briefs filed by the parties as well as the applicant’s Financial Statement.
[4] I provided my views on the state of disclosure that remains outstanding. The respondent requires a brief opportunity of determining if he is going to engage the Accountant previously retained to assist him in recreating his corporate financial picture. In view of the time that has passed since the original disclosure requests were presented, a very brief opportunity shall be afforded to the respondent. If retained, the Accountant will be required to provide a timeframe in which he can complete his mandate. It is expected that any lengthy delay will be deemed unreasonable.
[5] Regarding the respondent’s personal disclosure, it would appear that it is substantially within his counsel’s ability to exchange it with the applicant within a short window of opportunity.
[6] It is also apparently agreed that the respondent will be required to produce a valuation of both his corporate interests as well as his income. The timing of the delivery of this information is likely dependent upon the Accountant fulfilling his mandate.
[7] I leave it to the parties to exchange proposals regarding disclosure timelines and subject matter as well as support. On the latter issue, I have provided an option on how the parties may wish to proceed.
[8] I am allowing the parties until 12:00 p.m. on May 27 in which to communicate with me to apprise me of the fruits of their labours. Correspondence shall be forwarded to me in care of my Judicial Assistant at NewmarketJudSec@ontario.ca.
[9] If the parties reach a consent on disclosure requiring an Order, I would appreciate receipt of an approved draft for my signature. If a consent is reached on support and an Order is requested, I would appreciate receiving a draft approved Order, a Support Deduction Information Sheet and a Support Deduction Order.
[10] Absent consent on any issues, I will make a procedural Order regarding disclosure, imposing timelines I deem to be reasonable. I will also take under consideration if the request for support is one of urgency, on a without prejudice basis, and then request that the Trial Coordinator assign the matter to another Justice for hearing, subject to the assigned Justice also finding urgency.
