Addendum

[1] Pursuant to paragraph 78 of my Endorsement dated March 25, 2020, a teleconference was held with counsel for the parties today. The parties have agreed that the correct amount owing, with accrued interest to September 25, 2019 is $284,164.56, calculated in accordance with the interest calculation document attached hereto as Schedule “A”. Paragraph 77 of my Endorsement shall be amended so that judgment shall issue accordingly in favour of the Defendant in this amount.

[2] Given that court operations remain suspended now until July 6, 2020, counsel may still serve and file their costs submissions in accordance with the timelines provided for in paragraph 79 of the March 25 Endorsement, subject to the following:

a. Service of submissions may be conducted by email; b. Submissions shall be filed with the Court by email sent to: CSD.ThunderBay.SCJ@ontario.ca; c. If counsel refers to any caselaw, provided their submissions contain hyperlinks to the cases they shall not be required (although may, if they wish) to file a book of authorities or full copies of the cases; and d. Upon resumption of full operation of the Court, counsel shall file hard copies of all submissions previously sent by email.
