Referral to Construction Lien Master

[1] On February 18, 2020, the Plaintiff commenced this action pursuant to the Construction Act, RSO 1990, c. C.30. The claim relates to the supply of materials and services to an improvement of property in Toronto.

[2] On March 10, 2020, the Defendant served a Statement of Defence. On March 13, 2020, the Plaintiff served a Reply. Pleadings are now closed.

[3] Counsel for both parties have agreed on behalf of their respective clients to refer this matter for trial before a Master. A signed Consent dated April 23, 2020 is contained in the Motion Record before me. The affidavit of Bryce Dillon states that counsel are unaware of any other parties that will be affected by the relief sought in this motion.

[4] This action is hereby referred to a Master for trial in Toronto.
