Urgent Case Conference Endorsement and Order
[1] On April 3, 2020 McGee J. ordered that a case conference proceed on the issue of the father’s access to the parties’ 1 ½ year old child (see 2020 ONSC 2947) and on April 8, 2020 I gave directions with respect to the procedure to be followed (see 2020 ONSC 2179). The parties complied with those directions and a case conference was scheduled for, and proceeded on, April 23, 2020. The parties audited the teleconference.
[2] I expressed my views and gave recommendations to the parties with respect to, specifically, the urgent issue of access and, more generally, the court’s parenting expectations of the parties. The lawyers indicated that they would confer with their clients and advise whether a consent Order could be negotiated.
[3] On April 28, 2020 the court was advised that the parties had consented to an Order dealing with the child’s time with his father. A signed consent and draft approved Order were filed. Accordingly:
(a) An Order shall issue as per the approved Order filed;
(b) Subject to any future matter of an urgent nature and the Chief’s Notice, as may be revised, dealing with the re-opening of the courts, the next event shall be a case conference to deal with any non-parenting issues (such as support or equalization of the parties’ net family properties, if applicable). The parties should exchange Requests for Information and provide to the other party all reasonable and proportional disclosure as soon as practicable.
[4] I thank counsel for their assistance and commend the parties for prioritizing their son’s well-being.
[5] In the circumstances of the COVID-19 emergency, this Order is operative and enforceable without any need for a signed or entered, formal, typed Order. The parties may submit a formal Order for signing and entry once the court re-opens.
